By accessing or using TarsierExpressHouse services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.
Our services are available for personal and commercial use. You may not use our services for any illegal or unauthorized purpose nor may you, in the use of the service, violate any laws in your jurisdiction. You are responsible for ensuring that your use of our services complies with all applicable laws and regulations.
TarsierExpressHouse is not responsible for the contents of packages. Users are responsible for ensuring that packages comply with all applicable laws and regulations. Prohibited items include but are not limited to: illegal substances, hazardous materials, and perishable items without proper packaging. We reserve the right to refuse service or report to authorities any packages suspected of containing illegal or dangerous items.
Payment for our services is due at the time of service. For COD (Cash on Delivery) services, we will collect payment from the recipient and transfer it to the sender according to our payment schedule, less applicable fees. All fees are non-refundable unless otherwise specified. We reserve the right to change our fees at any time with appropriate notice.
When you create an account with us, you must provide accurate and complete information. You are responsible for safeguarding the password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to comply with these requirements.
By using our mobile application, you agree to accept automatic updates and changes to the application. You may be required to accept updates to the application in order to continue using it. Your use of the application is also subject to the terms and conditions of the app store from which you downloaded the application.
TarsierExpressHouse shall not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the services. In no event shall our total liability to you for all claims exceed the amount paid by you to us for the services during the past six months.
You agree to defend, indemnify and hold harmless TarsierExpressHouse and its employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the service.
We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the service.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our service after any revisions become effective, you agree to be bound by the revised terms.
These Terms shall be governed and construed in accordance with the laws of the Philippines, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
